The third suspect arrested on July 29 in connection with a 2013 Easter Sunday kidnapping incident in Thorsby was indicted by an August grand jury on charges including robbery and criminal solicitation.
Jonathan Bryant Fuller, 44, of Moulton, was charged with criminal solicitation and first-degree robbery, according to court records.
He was scheduled to appear in court Tuesday morning for a preliminary hearing, but an order filed Tuesday by Chilton County District Judge Rhonda J. Hardesty said Fuller had been indicted.
The order said a district attorney appeared and notified the court that Fuller had been indicted and the case was assigned to a circuit judge.
Fuller’s arraignment will be Sept. 10 at 8 a.m. at the Chilton County Courthouse before Chilton County Circuit Judge Ben A. Fuller, according to court records.
Fuller was taken to the Chilton County Jail, and was released July 31 on a $175,000 bond.
Agents with the Alabama Law Enforcement Agency arrested Fuller for his alleged involved in the March 31, 2013 robbery of Charles Dunlap, according to a press release from the 19th Judicial Circuit District Attorney’s Office.
The arrest was a result of a “lengthy” investigation, which required a multi-agency effort from law enforcement, the release said.
ALEA previously arrested Jerome Panagiotis Theodoroy and Scotty Ray Smith, both of Moulton, for three counts of kidnapping second-degree and two counts of robbery first-degree in 2013.
Theodoroy and Smith have both plead guilty to their involvement in the robbery in October 2014, the release said.
During a court hearing in 2014, Donna Henderson, one of the victims involved in the case, testified she stopped by Dunlaps’ home with her husband, Tim, to check on the elderly man who was terminally ill with cancer.
The visit happened during the robbery, she testified.
The three victims were then held at gunpoint with the two men tied up, and Donna Henderson was forced to go to her home on Jones Street to give Smith and Theodoroy money.
She was later dropped off in a rural area of Calera.
Henderson was able to return to Dunlap’s home and locate both Tim Henderson and Dunlap, who had not been seriously injured.
Dunlap passed away several weeks later, after the crime occurred.
The Moulton Advertiser reported that Fuller ran for a seat on the Lawrence County Commission in 2006 and then ran for Moulton mayor in 2012.
Fuller lost both races, according to The Moulton Advertiser.
Fuller owns Fuller Automotive in Moulton.
