Two individuals involved in two separate fatal traffic cases in Chilton County will appear in court this month.

Kevin Ray Ousley, 29, of Jemison, faces charges after driving under the influence of a controlled substance, and texting, when he crashed into another car on Interstate 65 North at mile marker 212 in Chilton County in 2013, leaving one man dead, according to court records.

Ousley was driving a Toyota Camry that crashed into a Jeep Cherokee about 7:15 a.m. on Aug. 22, 2013.

The passenger in the Jeep, Jackie Alan Faircloth, 65, was killed in the crash, and the driver, Patricia Faircloth McCain, 67, was hospitalized with serious injuries.

Ousley faces multiple charges in the crash: one count of reckless murder, manslaughter, criminally negligent homicide and driving under the influence, and two counts of vehicular homicide, according to court records.

A warrant was issued for his arrest on Aug. 11, 2014, almost a year after the wreck occurred.

The indictment states that on the day of the wreck, Ousley was driving under the influence of a controlled substance—methadone and/or clonazepam, and was writing, sending or reading a text message.

Ousley is set to appear in court on Oct. 15 at 9 a.m. before Chilton County Circuit Judge Ben A. Fuller where Ousley will inform the court whether the case will go to trial or whether he plans to plead guilty.

A separate case involving a Montevallo woman will head to court Oct. 29 at 8:30 a.m. in front of Chilton County Circuit Judge John B. Bush.

Amanda Rhoden Kizzire, 32, was indicted in August on three charges including murder-reckless, driving under the influence, and reckless driving, according to court documents.

According to the indictment, Kizzire “recklessly engaged in conduct with manifested indifference to human life and created a grave risk of death to a person and thereby caused the death of David Thomas Bryant.”

The Calera Police Department investigated the crash, which happened at about 5:40 a.m. on Sept. 6, 2013, on Highway 31 just north of Chilton County Road 95. The crash involved a motorcycle and an SUV.

Calera Police Sgt. Deven Heathcock, an investigator in the department’s traffic homicide unit, said at the time of the crash that Kizzire was traveling on the wrong side of the road when she collided with Bryant, 35, of Jemison, who was driving a motorcycle.

The two collided head-on near County Road 95.

Bryant was killed at the scene, and Kizzire was transported to UAB and treated for minor injuries and released later that day.

The indictment also states Kizzire operated a motor vehicle in Chilton County while under the influence of methamphetamine and or amphetamine.

Kizzire was arrested Sept. 9, 2013, and later released from the Chilton County Jail on a $162,500 bond in June.

Kizzire’s plea day was originally scheduled Sept. 25 at 8:30 a.m., but she failed to appear in court due to being hospitalized for a “severe eye injury,” court records show.

Judge Bush filed an order Oct. 9 rescheduling Kizzire’s plea hearing for Oct. 29.

At her hearing, she will have the option to have her case go to trial or plead guilty to the charges.
